Purchaser has a non-exclusive license to use the contents of a single manual at a single location for application for up to 10,000 managed care members unless written permission is granted for use at multiple sites or use for the review of a larger number of members. Purchasers may reproduce a limited portion of the manual for use at a single location (including distribution to contracted providers), usually not to exceed 3 to 5 pages without specific permission of Apollo. It is not a license to distribute the materials to other parties by any means, to create derivative works, to sell, assign, lease or sublicense the right to use the manual or the discs. CDs may not be copied except as a single ‘back-up copy’ for each manual purchased. A special agreement or license is required for installation into an electronic system or installation into a customized information system or database of any kind or electronic transmission by any means.

These materials are provided “as is” without warranty of any kind, expressed or implied, including, but not limited to, the implied warranties of merchantability and fitness for a particular purpose. In no event will publisher/licenser or distributor be liable for any loss of profits, loss of business, loss of data or use of data, or for indirect, incidental, special or consequential damages of any kind arising from the use or inability to use the materials. Purchaser agrees to hold publisher and editor harmless for its use of any materials contained in the Manual and to defend and indemnify against claims, liabilities, losses or damages, costs or expenses of any kind, (including attorney’s fees) which may arise as a result of purchaser’s use of the Manual or any accompanying material in written or electronic formats.
